Current Joint Resource Management Plans
The joint state/tribal resource management plans (RMPs) listed to the left have been evaluated by the Northwest Region for consistency with the 4(d) rule for limitation of take prohibitions. The 4(d) rule (Limit 6) says that fishery harvest or artificial propagation activities described in RMPs developed under U.S. v. Washington or U.S. v. Oregon are not subject to take prohibitions under Section 9 of the Endangered Species Act, provided they're conducted in accordance with an RMP that meets the criteria of the 4(d) rule.
The public was given an opportunity to review and comment on each evaluation and determination document. NOAA Fisheries Service has determined that these RMPs meet the rigorous criteria described in the 4(d) rule, and that activities conducted in accordance with these RMPs and their associated monitoring and reporting requirements will not appreciably reduce the likelihood of survival and recovery of listed species affected by those fisheries.
